A class action lawsuit says the town of Walkerton should have known two years ago about E.coli contamination.
Victims of the water tragedy say people were getting sick with E.coli O157 in the summer of 1998.
Jamie Smith says his son was one of four children at a day care to get sick two years ago.
The allegations are contained in an affidavit, and have not been proven in court.
Smith's son recovered, but the whole family later fell ill when E.coli contaminated the water supply in May.
The associate medical officer of health for the Bruce-Grey-Owen Sound health unit says the outbreak was investigated, but the source of the E.coli was never found. Dr. Walter Ewing says the bacteria could have come from contaminated food.
