Justin Christopher Miller pleaded guilty to aggravated sexual assault
A 28-year-old Port Hawkesbury, N.S., man has been sentenced to 12 years in prison for a brutal sexual assault on a young woman.
Justin Christopher Miller pleaded guilty to aggravated sexual assault for the attack, which happened in August, 2010.
He was sentenced in January of this year, but the sentencing decision was only published on Tuesday.
At his sentencing, the court heard how Miller followed a young woman home from a party, catching up to her on the lawn of the Port Hawkesbury court house. In her statement, the woman described how Miller tackled her and knocked her to the ground.
She said Miller was choking her and told her he'd kill her if she tried to get away.
She said he punched her in the face several times. He then proceeded to rape her and forced her to perform oral sex.
She was left with a broken jaw, lacerations and bruises to her face, arms, legs and back. She required surgery to repair her jaw, which had to be temporarily wired shut.
In an assessment prepared for court, Dr. Angela Connors said Miller appears to become aroused by non-consensual sexual contact. Connors also determined Miller is a high risk for future violence including sexual assault.
In her victim impact statement, the woman told the court "My carefree and positive spirits were washed away and replaced with anxiety and darkness," she said."I am still constantly looking behind my shoulder and am terrified to walk alone when it is dark."
"He took away my freedom."
In handing down her sentence, Justice Cindy Bourgeois spoke to Miller about his young son, who he has no contact with.
"You can become a person that your son may want to know," Bourgeois said.
Miller is getting credit for the more than 28 months he spent in custody while awaiting trial.
His remaining sentence is nine years, seven months and four days
Miller also faces a lifetime weapons ban, must provide a DNA sample and his name will go on the national sex-offender registry.
