Teacher William MacGillivray elects jury trial on sex charges

A teacher from Harrison Trimble High School in Moncton has elected to be tried by judge and jury on sex-related charges involving two girls.

William MacGillivray, 41, chose his mode of trial through his lawyer in provincial court on Monday. MacGillivray was not present in court.

A preliminary hearing to determine if there is enough evidence to proceed to trial was scheduled for Sept. 22-23.

MacGillivray was initially charged in December with child luring, sexual exploitation, sexual assault and obstruction involving a girl under the age of 18.

In January, a new alleged victim came forward. MacGillivray was then charged with sexual exploitation dating back to 2010-11 and with breaching a court undertaking by not reporting a change of address to police.

The initial charges are alleged to have occurred between March and November while MacGillivray was in a position of trust.

MacGillivray was also a drama instructor at the school.

He was released on bail on Dec. 20 on several conditions, including that he not be alone with girls under the age of 18 unless with an adult. He is also not to have any contact with the initial complainant or her family and not possess a device to access the internet unless it's at work.

MacGillivray was also ordered to report weekly to police and to submit to searches by police without a warrant.
