MacGillivray, 41, a teacher at Harrison Trimble High School, is accused of child luring, two counts of sexual exploitation, obstructing a police officer and breach of a court undertaking.

He appeared in a Moncton provincial courtroom Tuesday.

After a two-day preliminary hearing, defence lawyer Scott Fowler said he had discussions with the Crown, and agrees to have the matter set over for trial in Moncton Court of Queen's Bench. A court date for the trial has not been set.

MacGillivray had also been charged with sexual assault, but that charge was withdrawn on Monday.

MacGillivray, also a drama instructor at the school, was initially charged in December with child luring, sexual exploitation, sexual assault and obstruction involving a girl under the age of 18. In January a second alleged victim came forward and MacGillivray was charged with sexual exploitation dating back to 2010-11 and with breaching a court undertaking by not reporting a change of address to police.

He was released on bail in December on the condition he not be alone with girls under the age of 18, unless with an adult. He is also not to have contact with the initial complainant and her family and can't possess a device with internet access unless he is at work.

MacGillivray is to report weekly to police and must submit to police searches without a warrant. He must also remain in the Greater Moncton area.
