“CBC/Scotiabank Hockey Tonight Kids” Contest

From October 5, 2010 to January 17, 2011 (“Contest Period”)

NO PURCHASE OF ANY KIND IS NECESSARY TO ENTER OR WIN.  MAKING A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.  VOID WHERE PROHIBITED BY LAW.

Entry into this Contest constitutes your acceptance of these Contest Rules

1. ENTRY PROCEDURE

To participate in the CBC/Scotiabank Hockey Tonight Kids Contest (the “Contest”), sponsored by CBC and The Bank of Nova Scotia (“Scotiabank”) (collectively, the “Contest Sponsors”), direct your internet browser to cbcsports.ca/hockey and click on the Contest promo button or banner to view the instructions on how to participate and enter the Contest.

To enter this Contest, entrants must simply register online and in doing so, the entrant is providing permission on behalf of his/her team for Contest Sponsors to use the information in the Contest if they wish. All entrants must register on behalf of his/her team via the online Contest page on cbcsports.ca/hockey.

Individuals may only enter on behalf of a team, and a team may only be entered once by one entrant. Entrants must be of the age of majority in their province or territory of residence and must be the person of authority with the right to speak or act on behalf of the team (such as a coach or parent/guardian of a child on a hockey team). Only entrants with team members 8 – 16 years of age can apply.

Entrants must provide certain information, including the following contact information, at the Contest site located at cbcsports.ca/hockey : entrant’s first and last name, date of birth, home address, day and evening telephone number, email address, team name, team regional selection, age group of team members, confirmation of the entrant as a parent/guardian or coach with the authority to register for this Contest on behalf of the team.

Entries will be accepted until the Contest’s close date of January 17, 2011 at 11:59 p.m. (ET) and all required fields on the entry form must be completed.

2. CONDITIONS OF ELIGIBILITY

This Contest is open to all legal Canadian residents who are of the age of majority in the province or territory where they reside. Directors, officers and employees, family members and those persons with whom they are domiciled or are living under the same roof, of the CBC, Scotiabank, the advertising, promotional and judging organizations and their affiliates and agencies (“Ineligible Persons”) are not eligible to submit an entry to this Contest. However, team members may include the children of Ineligible Persons other than the children of Directors or Officers of the CBC or Scotiabank.

3. PROCEDURE FOR AWARDING PRIZE

There will be thirteen (13) entrants selected from all of the valid registrations submitted, based on a random draw within each region set out below. The odds of winning a prize are directly related to the number of eligible entrants in each Region.

Regional Random Draw Breakdown are as follows:

  • Western Region (British Columbia and Alberta) 3 draws
  • Central Region (Saskatchewan and Manitoba) 2 draws
  • Ontario Region (Ontario) 3 draws
  • Quebec Region (Quebec) 2 draws
  • East Region (Nova Scotia, New Brunswick, Newfoundland and PEI) 2 draws
  • North Region (Yukon, Northwest Territories and Nunavut) 1 draw

Entrants selected via the random draw and that are otherwise qualified as winners (“Winning Teams”) will be requested to provide a short essay about the team and a photo of the team (to be used by CBC or Scotiabank for the Contest should they wish to use it). Some essay examples are: 1) The team’s passion for Hockey Night In Canada, 2) The opportunity to represent your local community, 3) Profile of a great coach, mentor and/or parent who give a lot of their time, 4) values and principles the team has learned from hockey, 5) Why it is fun to be on a hockey team.

All winning entries become the property of the Contest Sponsors and will not be acknowledged except as set forth herein. Winning entry data, where parental consent is given, may be used by the Contest Sponsors for marketing purposes related to this Contest including, but not limited to, the display of entry data on television, in branches or online and all promotional usage, without any financial compensation to the entrant or members of the team, unless such compensation is deemed payable by the Contest Sponsors, in their sole discretion.

The random draws will take place at the CBC Broadcast Center in Toronto on the dates set out below. Winning Teams will be notified by telephone or email As well, the entrants will be responsible for providing consent waivers for any essays and photos that feature or profile personal details about team members or a community member. Winning Teams must assign all proprietary and moral rights and any other rights to their photos and essays. Each Winning Team shall appoint a representative who must answer a mathematical skill-testing question to be declared a winner.

In the case a Region does not have sufficient amount of entries for a specific draw date, the Contest Sponsors will make a random selection from the pool of all entries that have not been chosen to date.

4. DESCRIPTION OF PRIZE

Each Winning Team will be featured on the pre-game show, Scotiabank Hockey Tonight. A different Winning Team will introduce CBC’s Hockey Night in Canada each week by video during the regular hockey season. Winning teams will be photographed and video taped at a local rink in their home town preceding the show. Entrants will be responsible for providing to CBC parental consent waivers for each member of the Winning Team before the Introduction is video taped at a local rink. The video and photos may also be featured on the website cbcsports.ca/hockey.

The Winning Teams will also receive a pizza party hosted by Scotiabank and an “official Hockey Night In Canada and Scotiabank Hockey Tonight Kids” towel for each player. Video announcements will appear on CBC Television and the Contest website and may be recorded in either English or French (No monetary value is attached to the prize).

5. GENERAL REGULATIONS

5.1 Any Winning Team that cannot be contacted (or whose representative fails to respond to any telephone message left for such Winning Team) within three (3) days of the first attempt to contact such team may, at the sole discretion of the Contest Sponsors, be disqualified and the Contest Sponsors reserve the right, in such event, in their sole discretion, to select another team.

5.2 Winning Teams shall agree, if required by the Contest Sponsors, to have their name and/or picture and/or video images, more particularly their photograph, and/or their voices used for advertising purposes related directly or indirectly with this Contest, without compensation.

5.3 Winning Teams shall sign a form attesting to their eligibility as stipulated in these Contest Rules and releasing the Contest Sponsors, their affiliates and agencies, and their respective directors, officers and employees, from any and all liability for any damage or loss resulting from participation in this Contest or arising directly or indirectly from the awarding, acceptance or use of the prizes.

5.4 The prizes shall be accepted “as is” and may not be exchanged for an amount of money, nor sold nor transferred. No substitutions will be allowed. The Contest Sponsors reserve the right to modify, cancel or withdraw the prize for any reason acting in their sole discretion.

5.5 Refusal to accept any prize releases the Contest Sponsors, their affiliates and agencies, and their respective directors, officers and employees of all further obligations or liabilities.

5.6 The Contest Sponsors, their affiliates and agencies and their respective directors, officers and employees are not responsible for typographical or other errors in the offer or administration of the Contest, including but not limited to errors in advertising, the Contest Rules, the selection and announcement of Winning Teams, or the distribution of any prize.

5.7 The Contest Sponsors, their affiliates and agencies and their respective directors, officers and employees shall assume no liability of any kind whatsoever for any failure of the website  ( cbcsports.ca/hockey ) , including any problems or technical malfunction of any computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail or entry to be received on account of technical problems or traffic congestion on the internet or at any website, or any combination thereof including any injury or damage of an entrant’s or any other person’s computer related to or resulting from  downloading any material related to the Contest, all of which may affect a person’s ability to participate in the Contest.

5.8 The Contest Sponsors, their affiliates and agencies and their respective directors, officers and employees shall assume no liability of any kind whatsoever resulting from (i) lost, late-received, illegible, incomplete or misdirected entries, or (ii) entries which fail to comply with these Contest Regulations.

5.9 The Contest Sponsors, their affiliates and agencies and their respective directors, officers and employees shall assume no liability of any kind whatsoever in any cases in which their inability to act results from an event or situation unforeseeable or beyond their control, including more particularly a strike, lock-out or any other labour dispute in their place of business or the places of business of the organizations or businesses whose services are used to hold this Contest.

5.10 The Contest Sponsors, and each of their officers, directors, affiliates, related entities, partners, partnerships, principals, representatives, agents, licensees, sponsors, successors and assigns (i) make no warranty, guaranty or representation of any kind concerning any prize, (ii) disclaim any implied warranty, and (iii) are not liable for injury, loss, or damage of any kind resulting from the acceptance or use of any prize, travel related thereto or from participation in the Contest.

5.11 By participating in this Contest, all entrants agree to release and hold harmless the Contest Sponsors, the NHL Entities, their respective parent companies, their affiliates and agencies and their respective directors, officers and employees from any and all liability whatsoever for any injuries, losses or damages of any kind to any person or property arising from or in connection with, either directly or indirectly, (i) the awarding, acceptance, receipt, possession, use and/or misuse of any of the prizes or parts thereof awarded pursuant to the Contest, or (ii) the participation in the Contest or any prize-related activities, including, but not limited to, traveling to or from any prize-related activity.

5.12 Participation in this Contest includes acceptance of these Contest Rules. All decisions made by the Contest Sponsors are final.

5.13 These Contest Rules are available on cbcsports.ca/hockey and any breach of these Contest Rules by an entrant shall result in disqualification.

6. ADMINISTRATOR:

CBC is the administrator of the Contest.

7. PRIVACY:

By entering this Contest an entrant consents to the collection, use and disclosure of his/her personal information, which includes name, address, age, postal code, telephone number and e-mail by CBC and the Prize Provider for the purposes outlined in these Rules or for market research and promotional purposes and in accordance with CBC’s privacy policy at: http://www.cbc.ca/aboutcbc/discover/privacy.html and Prize Provider’s privacy policy at scotiabank.com

In addition, if the entrant gives the appropriate consent on the Contest entry page, the Contest Sponsors will be permitted to,

  • communicate with the entrant and to deliver an e-newsletter
  • communicate with the entrant about products and services that meet the entrant’s needs;
  • market products and services of Contest Sponsors;
  • provide the entrant with special offers and rewards;

All personal information, including all photos and essays submited by a Winning Team, will be destroyed within four (4) months following the Contest Period unless the Contest Sponsors have obtained permission from the entrant and through parental waivers to use the information for other purposes beyond the Contest time period. All winning entrants will be responsible for providing to CBC, parental consent waivers for each member of the Winning Team before the Introduction is video taped at a local rink. As well, entrants qualified as a winner will be responsible for providing consent waivers for team members or a community member, profiled or featured in the essay and team photos.
