The Hockey Night in Canada Help Fund APPLICATION PROCEDURE

The Hockey Night in Canada Help Fund (“HNIC HF”) was established in 2008 under a 6-member leadership team (“Leadership Team”) to assist more Canadians to participate in the game of hockey.

OBJECTIVES

Through the HNIC HF, eligible groups (“Groups”) across Canada will be provided financial assistance that will:

·         Provide Canadians facing financial and geographical barriers an opportunity to participate in the game of hockey;

·         Make the sport of hockey available to the most number of Canadians; and

·         Utilize the sport of hockey as an instrument of national unity

(the “Objectives”).

APPLICATION PROCEDURE FOR 2011

1. APPLICATIONS

Applications will ONLY be accepted commencing on
January 1, 2011, to March 31, 2011, 11:59 PM EST.

Beginning January 1, 2011 you can obtain an application form for the HNIC HF:

·         online at http://www.cbc.ca/sports/hockey/hockeynightincanada/helpfund/ (the “Website”); or,

·         by calling 1-866-220-6688 to have a copy mailed to you.

To apply you are required to do the following:

·         submit a completed application form, including your answers to all questions on the application form and an essay between 250 to 500 words [the completed application form submitted by an Applicant, either on their own or on behalf of a Group, collectively the “Application”] that provides a detailed description of your or your Group's activities, how they relate to the Objectives of the HNIC HF and an overview of the proposed use of the Award towards a specific activity (the "Initiative").

Any Application that is not complete or deemed not in furtherance of the Objectives will be rejected at the sole discretion of the Leadership Team. All Applications shall become the property of CBC and will not be returned to Applicants.  CBC shall have an unrestricted right to use the Applications for any purpose including but not limited to the promotion of the HNIC HF, Hockey Night in Canada or CBC.

Applications must contain the following information:

1.         A detailed description of the Applicant’s or Group's activities and how they relate to the Objectives of the HNIC HF, including how many people will participate in and be exposed to the Initiative;

2.         The principle individuals involved in the Initiative;

3.         A budget for the entire Initiative;

4.         The amount requested from the HNIC HF; and

5.         The start and end date of the Initiative.

HNIC HF is not liable for lost, late, stolen, illegible, incomplete or misdirected Applications.


Note:  All Applications must: (i) be original works of the submitting Applicant; (ii) not have been previously published or won any other prize/award; and (iii) not infringe copyright or other intellectual property rights of any other party, including but not limited to any person, group, entity, or company. All uses of Hockey Night in Canada, Hockey Night in Canada Help Fund or CBC Official Marks are subject to approval by the CBC.

2. SELECTION PROCESS

Successful Applicants (“Recipients”) will be selected by a 6-member Leadership Team consisting of senior CBC managers, Hockey Night in Canada talent and representatives from the hockey community.

The Leadership Team will select Recipients by evaluating the Applications.

The decisions of the Leadership Team are in its sole discretion and are final (see Section 5, General Rules, below).

The Recipient(s) will be announced on Hockey Night in Canada on CBC on or about June 1, 2011.  Recipients will be contacted by email or telephone and/or courier no later than June 1, 2011.

3. CONDITIONS OF ELIGIBILITY

HNIC HF is open to all Canadian not-for-profit organizations, charities and individuals and other groups undertaking activities that are non-commercial in nature.

The Applicant must be a legal resident of Canada. An individual Applicant may apply on behalf of any Group.  The Applicant must be of the Age of Majority.  A parent or legal guardian of a minor may be the Applicant on behalf of a minor(s).  In the event a Group is selected as a Recipient and members of the Group are minors, a parent or legal guardian of any minor participating in the Group must sign a release permitting the minor to participate in any Initiative funded by an Award.

Directors, officers and employees of Sponsors (as defined below) and each of the directors, officers, employees, and members of the Sponsors’ affiliated companies, advertising and promotional agencies and/or representatives, the Leadership Team, directors, officers and employees of CBC and any person or entity connected with the administration of HNIC HF (collectively, the “HNIC HF Parties”), and immediate family members of any of the foregoing or those with whom any of the foregoing are domiciled are not eligible to apply to the HNIC HF.

Applicants and members of any Groups must not be encumbered by any obligations relating to sponsorship.

4. AWARDS FROM THE HNIC HF

The Leadership Team reserves the right to determine the amount of each Award.  Awards are non-recurring.  The maximum amount of any Award from the HNIC HF will be $10,000.00.  CBC and/or the Leadership Team can elect to not make any Award from the HNIC HF in any particular year, to make Awards of less than $10,000.00 or to make multiple Awards.

In order to receive an Award, the Recipient will be required to sign appropriate documentation and such Award will be made subject to the following conditions:

·         CBC shall be represented in all promotional and communications material produced by the Recipient for the Initiative;

·         Any proposed use of CBC Marks shall be pre-approved by CBC in writing;

·         CBC shall have the right to attend any public event funded by the Recipient during the term of the Initiative;

·         No other broadcaster shall be permitted to have sponsor status at any event funded by the Recipient during the Initiative;

·         Any participants involved in the Initiative must sign a CBC-approved release prior to participation;

·         The Recipient must be available and agree to participate in any reasonable request by CBC to conduct its promotion without compensation; and

·         The Applicant must provide a full accounting and final cost report to CBC/Leadership Team detailing the use of the Award for the Initiative within 60 days of the end of the Initiative.

5. GENERAL RULES

5.1         The Leadership Team reserves the right to change the structure, process, timing, duration or any other aspect of the Application Procedure at its sole discretion.  Additionally, CBC reserves the right to suspend, cancel or postpone the making of any Awards in its sole discretion. 

5.2         CBC reserves the right to amend the Application Procedure or terminate the HNIC HF at any time without any liability to any Applicant.

5.3         It is a condition of Application that Applicants/Recipients agree, sign and abide by all applicable Release Forms and this Application Procedure as devised from time to time by the Leadership Team and CBC.  CBC may request Applicants/Recipients to participate, free of charge, in any activity relating to the promotion of the HNIC HF including without limitation recordings and participation in interviews, appearances, promotional, and publicity activities.

5.4         The Leadership Teams’ decisions are final and the Applicants acknowledge that the interests of the HNIC HF shall override those of any Applicant. 

5.5         All Applicants agree that, to the extent permitted by law, CBC and its agents can use, exploit, and distribute in any media whatsoever, including without limitation the Internet, now known or hereafter created, worldwide in perpetuity, the Applicant’s Application, the Applicant’s and/or Group’s name, likeness, image, voice, comments and appearances without any further consent or compensation.  Further, by applying for an HNIC HF Award, each Applicant represents and warrants that each individual who is included in the Application Materials (each an "Other Individual," and collectively, the “Other Individuals”) has as of the date of the Applicant’s submission, agreed that the CBC and their agents can use, exploit, and distribute in any media whatsoever, including without limitation the Internet, now known or hereafter created, worldwide in perpetuity, such Other Individual’s name, likeness, image, voice, comments without any further consent or compensation. By applying, all Applicants and Groups agree to waive any and all copyright interest, of any nature or kind, they may have in their Application Materials, including but not limited to essays written by the Applicant, and appearances, including without limitation any moral rights in the foregoing, and unconditionally assign such rights and interests to CBC. By applying for an HNIC HF Award, each Applicant represents and warrants that each Other Individual has, as of the date of Applicant’s submission, agreed to waive any and all copyright interest, of any nature or kind, they may have in any Application Materials provided in connection with the application, including but not limited to essays written by the such Other Individual or an Applicant, and appearances, including without limitation any moral rights in the foregoing.

5.6         CBC shall own all rights, including copyright, in the Applications including but not limited to the essays written by the Applicants. CBC shall have the right to edit or extract the Applications for use in perpetuity.

5.7          All Applicants shall sign a document attesting to their eligibility as stipulated in these Application Procedures.

5.8         Applicants acknowledge that the HNIC HF Parties and each of their directors, officers, employees and members are not responsible for and are in no way liable for any injuries, loss or damages arising from an Applicants application to the HNIC HF. 

5.9         Refusal to accept an Award releases CBC, the Leadership Team and HNIC HF Parties of all responsibility and obligations toward the selected Applicant.

5.10      All information requested by and supplied to CBC and the Leadership Team by each Applicant must be truthful, accurate, and in no way misleading.  CBC and the Leadership Team reserve the right to reject any Applicant, should the Applicant at any stage supply untruthful, inaccurate, or misleading details and/or information or should the Applicant be or become ineligible at any stage of the Application Procedure pursuant to these Application Procedures.

5.11     The HNIC HF Parties shall not be liable for any losses, delays, mistaken addresses, typographical errors, errors on printed or electronic material, technical, computer or telephone malfunctions, loss or theft of computer data, damage to software or computer equipment, fraudulent calls or any other mistake.  The HNIC HF Parties reserve the right to seek remedies and damages from any such individual, to the fullest extent permitted by law, including criminal prosecution.

5.12     Under no circumstances, including negligence, shall the HNIC HF Parties be liable for any direct, indirect, incidental, special or consequential damages that result from the use of or inability to use the Website, nor assume any liability for any personal injury or property damage or losses of any kind, including without limitation, direct, indirect, consequential, incidental or punitive damages which may be sustained to an Applicant’s or any other person’s computer equipment resulting from user’s attempt to make an application to the HNIC HF or download any information in connection with making an application to the HNIC HF or use of the Website. Without limiting the foregoing, everything on the Website is provided, “as is” without any warranty of any kind, either express or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose or non-infringement.

5.13     The HNIC HF Parties shall assume no liability whatsoever for any situation in which their inability to act results from an event or situation unforeseeable or beyond their control, including but not limited to force majeure, a strike, lockout or any other labour dispute at their location or the locations of the businesses whose services are used to administer the HNIC HF.

5.14     Any on-line or mail in Application or other materials used in this Application Procedure that have been tampered with, altered, reproduced, not legitimately obtained, or which contain or reflect any error will be void. Without limiting the generality of the foregoing, CBC reserves the right to cancel or suspend the making of any Awards from the HNIC HF or to cancel the HNIC HF altogether for any reason including fraud, technical failures, any network server or hardware failure, viruses, bugs, errors in programming, or any other errors or other causes beyond the control of the HNIC HF Parties that may corrupt the administration, security, or proper execution of the Application Procedure.

5.15     By providing personal information in the Application, all Applicants consent to it being used for the purposes of promoting and administering the HNIC HF, Hockey Night in Canada and the CBC. 

5.16     This Application Procedure is available at the Website.  Any questions about the Application Procedure can be answered by emailing hockeyhelpfund@cbc.ca.  Taxes and fees, if any, are sole responsibility of Recipient.


DEFINITIONS

Award – A monetary sum to be given to a selected Recipient from the HNIC HF in accordance with the Application Procedure.

Age of Majority— Applicant must be at least 18 years old in Alberta, Manitoba, Ontario, Prince Edward Island, Quebec and Saskatchewan.  Applicant must be at least 19 years old in British Columbia, New Brunswick, Newfoundland and Labrador, Northwest Territories, Nova Scotia, Nunavut, and Yukon.


Applicant(s)—Any person who on his or her own or who represents a group of people who applies for an Award from the HNIC HF (such group sometimes referred to in these Application Procedures as a “Group”).

Application – The materials required to apply for an Award from the HNIC HF.

Application Procedure – The process set out in this document outlining how an Applicant can apply for an Award from the HNIC HF.

Leadership Team - Such person(s) as the CBC may nominate from time to time to evaluate and select Recipients of any Award.

Objectives – The aims of the HNIC HF which are to: provide Canadians facing financial and geographical barriers an opportunity to participate in the game of hockey; make the sport of hockey available to the most number of Canadians; and utilize the sport of hockey as an instrument of national unity.

Release Form(s)—Any release form supplied from time to time by CBC that an Applicant or members of a Group are required to sign in connection with the Application Procedure.

Sponsors – Any entities that CBC chooses to partner with in the promotion of CBC, Hockey Night in Canada or the HNIC HF.
