Precedent set by Abitibi-Bowater case

On Friday, the Supreme Court of Canada decided Abitibi-Bowater can't be forced to deal with the mess it made ahead of other creditors who want to be paid. The province challenged that decision by lower courts, and argued the polluter must pay, regardless of how many other creditors are owed money. The decision likely means the provincial government is on the hook for Abitibi's pollution, to the tune of about a hundred million dollars. It also sets an important precedent for other cases across Canada. Will Amos is a lawyer representing Friends of the Earth, and had intervenor status in this case.
