Information Morning - Saint John WorkSafe NB Case Workers and Appeals Tribunal Have Differing Interpretations Of The Rules Mar 11, 2013 | 9:06The head of WorkSafe NB suggests there's one reason his commission's decisions are often overturned by the appeals tribunal, the tribunal panel has a different interpretation of the rules. The CBC's Rachel Cave spoke to tribunal chair Ronald Gaffney about the growing number of cases that are going to appeal. CBC learned that a large number of the commission's decisions are being overturned by the appeals tribunal. Nearly 80 per cent of the time that tribunal rules in favour of injured workers. Adams hinted that the problem may lie with the appeals tribunal itself. He suggested that the tribunal members have a different interpretation of the rules ... an interpretation that doesn't square with WorkSafe case-worker decisions. The CBC's Rachel Cave spoke to the chair of the appeals tribunal... She asked Ronald Gaffney about the growing number of cases that are going to appeal:
