Black, 64, is in a Florida prison serving a 6½-year sentence for fraud and obstruction of justice.
Judge Amy St. Eve, who presided at his 2007 trial, ruled Tuesday that it is not likely the Supreme Court will overturn the former media baron's obstruction conviction, even if his fraud conviction is quashed.
Black's lawyers have argued the Supreme Court would likely reverse the obstruction conviction if it reverses the mail fraud charges because "it likely will conclude that Mr. Black was prejudiced on the obstruction conviction too."
Last month, the U.S. Supreme Court had turned down an earlier request for bail by Black.
Black, who is the only Hollinger defendant still behind bars in the U.S., was convicted of three counts of fraud relating to the years he headed the company Hollinger International and one count of obstruction of justice.
The U.S. top court agreed in May to review Black's conviction, which has been upheld by the 7th U.S. Circuit Court of Appeals in Chicago. The U.S. Supreme Court also agreed to hear the appeals of two other former executives of Hollinger.
