A six-year-old girl who was allegedly kidnapped as an infant will be returned to her birth mother, a New Jersey judge ruled on Thursday.

Luz Cuevas and the girl's biological father will share legal custody of Delimar Vera, but the child will live with Cuevas.

On Monday, authorities in Philadelphia charged Carolyn Correa, 42, with kidnapping, arson and 13 other crimes.

They allege that Correa, an acquaintance of Cuevas, kidnapped Delimar from the Cuevas home when the girl was just 10 days old, then set fire to the house to cover up the abduction.

The child was presumed dead in the subsequent blaze, although her remains were never found.

In January, Cuevas became suspicious of the girl's identity after meeting her at a birthday party.

DNA tests subsequently confirmed that the girl, who Correa had raised as Aliyah Hernandez, was actually Delimar.

Correa is being held on $1 million US bail.
