Microsoft Corp. can keep selling Word, its flagship word processing software, after an appeals court granted a temporary stay of an injunction handed down in a patent infringement case.
The U.S. Appeals Court for the Federal Circuit's decision gives the software giant some time to fight a permanent injunction that a U.S. district court judge in Texas issued in August.
The Texas court had given Microsoft until Oct. 10 to stop selling the versions of Word that violated patents held by Toronto-based software company i4i. The patents related to the reading of XML, a data language commonly used online.
The court also ordered Microsoft to pay i4i $290 million US in damages.
Microsoft was given 60 days to comply with the Texas court's ruling, but the company said it feels that i4i's patents are invalid and launched an appeal.
The company argued the timeframe to stop selling Word was too short and would do "irreparable harm" to its business. The appeals court granted the stay of the injunction pending a hearing scheduled for Sept. 23.
