A Calgary judge has given a local man the right to grow his own marijuana for medicinal use.

Grant Krieger uses cannabis to help control the seizures he suffers from multiple sclerosis.

Grant Krieger was charged with cultivating marijuana and possessing it for the purpose of trafficking. But Court of Queen's Bench judge, Darlene Acton, struck down the cultivation charge.

She says it's "absurd" that the federal government is allowing people to apply for permission to use cannabis as medicine while not providing for a legal and legitimate source of getting the drug.

Krieger's lawyer, Adriano Iovinelli, says Monday's decision should force Ottawa to change the law. "It's another message to the government of Canada that they have to address this issue more thoroughly," says Iovinelli.

Krieger still faces a trafficking charge and will be back in court on January 10th.
