A Quebec judge has authorized a class action lawsuit to go ahead against Bell Mobility for charging early termination fees on a wireless contract.
(CBC) A Quebec Superior Court judge has authorized a class action lawsuit to go ahead against Bell Mobility.
The case was launched by Denis Gagnon, a former Bell customer, who said the cellphone provider illegally charged him hefty early contract termination fees.
Gagnon's lawyer, BenoƮt Gamache, said most customers are unaware they could be charged those fees.
"It's more than unfair. These fees have not been disclosed. You have to understand that nowhere does it appear in the contract, when most of the people are signing their service contract with Bell Mobility, that they have to pay three, four, five hundred dollars if they put an end to the contract."
Gagnon wants Bell to reimburse his $200 termination fee. He is also seeking $2 million in punitive damages, which he would share with others joining the suit.
Gamache believes that could include up to 20,000 eligible plaintiffs.
