A member of the Windsor Spitfires is charged with assaulting a 16-year-old girl and police say he is being investigated for another assault.

Police say Ben Johnson of Calumet, Michigan, is charged with sexual assault following an incident Monday morning.

Windsor Police say they were dispatched to Metropolitan Hospital.

Their officers spoke with a 16-year-old female who alleged she had been sexually assaulted in a Windsor nightclub's washroom.

Nightclub working with police

The Windsor nightclub where the alleged assault happened posted a statement on their Facebook page Monday that they are working with police to determine why minors were allowed into the club.

The name of the nightclub is under a publication ban.

"We are currently working with police to figure out this matter," the statement reads. "Using false identification pieces is a huge issue at any establishment serving alcohol. We take all security precautions seriously."

The club also posted a general statement on abuse, adding that they do not condone "such reprehensible conduct."

"(The nightclub) sends out heartfelt concerns for any victim of abuse," the statement reads. "Not until the authorities brought to our attention that the alleged assault that occurred in (the club) did we become aware.

"We are working closely with the authorities by assisting in their investigation to see that justice is obtained. (The club) bears no responsibility for improper actions of others."

More assault charges

Police now say that Johnson is being investigated for another assault involving a young woman. They allege that assault happened three weeks ago.

In a release, the Windsor Spitfires said, "Earlier today our organization was made aware of accusations involving a player on our hockey team. Our organization will allow the legal process to run its due course at this time."

Pat Ducharme, Johnson's lawyer, said Monday that his client is upset by the allegations of sexual abuse.

"This is upsetting to him like it would be for anyone who is charged," Johnson said.

Ducharme said that Johnson will be released on Tuesday morning on $30,000 bail.

He said because Johnson is an American citizen, with plans to play in the NHL, it's important to fight the charges vigorously.

"Well any allegation of sexual assault is always serious. The possible penalties are serious," Ducharme said. "In addition to that, when you're a professional hockey player that plays in a league that crosses international borders on a regular basis, this is considered a crime of moral turpitude, so it can impede if not stop traffic across borders."

Johnson will stay with Spits general manager Warren Rychel when he's released, until he can return to his family in Michigan.
