Windsor's acting police chief confirms the Office of the Independent Police Review Director is now investigating an alleged police beating.

The arm's length branch of Ontario's attorney general looks into public complaints.

Windsor Police also confirmed the victim in the alleged assault, which was caught on surveillance camera, has filed a complaint.

Last week Windsor Police received the video which allegedly shows a young black man being kicked and punched by an officer.

Windsor Police Const. Kent Rice, who is white, has been charged with assault and suspended with pay.

Acting Windsor Police Chief Al Frederick said officers interviewed the 22-year-old alleged victim, which in turn triggered the "independent police review."

"I cannot tell you who he is. If he wants to disclose his identity, fine. But under the legislation, in regards to OIPRD, the complainant has privacy rights," Frederick said.

Injuries don't 'meet the threshold' for SIU

Ontario's Special Investigations Unit says it will not investigate the latest allegation of police brutality in Windsor because the incident does not "meet the threshold" for injuries, the agency said.

The head of Windsor's Black Coalition is disappointed in the SIU's decision. Marc Taylor said he was hoping the police watchdog would step in.

But, he said he does have faith in the city police investigation.

"I do know, however, that there's a complaint that was launched. The [victim] did meet with the police [Monday], and he lodged a public complaint," Taylor said. "As well, the criminal investigation is still ongoing."

The alleged assault of a young black man was captured on surveillance video in the stairwell of an an apartment building on McDougall Avenue.

It happened in February, but just came to light last week.

Taylor doesn't believe the race was a factor.

"There has been nothing that points towards this being a racially motivated situation. However, if during an interview with the victim it came out that the officer used a racial slur, then that's another story altogether," Taylor said.

Taylor plans to talk with the victim to see if the officer uttered any racial slurs.

The alleged assault came just weeks after acting Windsor Police Chief Al Frederick launched "Project Accountability." It is a 27-point plan designed to clean up the Windsor Police Service after Det. Dave Van Buskirk beat innocent and legally blind Dr. Tyceer Abouhassan.

Van Buskirk is serving five months for assault and 30 days for public mischief in relation to that April 2010 beating, which was also caught on tape.
