Leamington council has voted against a bylaw that would ban smoking on municipally-owned properties, such as parks, baseball diamonds, and beaches.
Leamington Mayor John Paterson has been consistent in his opposition to such a bylaw. He says the issue is the jurisdiction of the province.
"I don't think that's the municipal politicians' reason to exist; to dictate to people how they live their lifestyles," he said. "In order to make this fair and proper, the province has to step up to the plate."
Paterson has advised the Windsor Essex County Health Unit, which supported the bylaw, to take up its fight with the provincial government.
"It's a legal product. They sell it in stores. You can buy it in the stores. I don't see where municipal council has the authority to dictate to people how they live their lives," Paterson said.
