A mother and her common-law husband have been charged with second-degree murder in the death of a two-year-old boy in their care.

The victim, who died Sunday, was identified as 26-month-old Nicholas Cruz. Police said the child had signs of physical trauma on his body.

Marleny Cruz, 25, and Joel France, 36, both of Toronto, were charged in the case. France faces an additional charge of assault.

A post-mortem examination has been performed, police said.

The couple was scheduled to appear in College Park court this morning at 10 a.m.

Police said the victim was living with the two adults in the city's west end, near Walnut Street and Richmond Street West.
