A Sudbury man charged with attempted murder will remain out on bail, a judge has ruled.

Alex Klem, 67, is accused of shooting downtown business man Tony Monteleone last fall. Klem was released on bail in July. He is under house arrest and staying at his brother's home in southern Ontario.

Glenn Sandburg, Klem's defence attorney, said he's going to fight the charges, but when the matter will go to court remains in doubt.

"That's difficult to say because I have a lot of critical decisions to make, and my client and I have to spend some time considering how we're going to approach this, so it could be quite a while,” Sandberg said.

He said the bail decision brings relief to the family.

“Some people are unfortunate enough to come to bail court and they have no one,” Sandberg said.

“Not everyone has a wife and a brother and a sister-in-law to come forward and support them. Not everyone has the family who are as comfortable financially as these people are fortunate to be, [and are] as responsible and mature and able to support him.”

Assistant Crown attorney Alex Kurke said he is not considering appealing the bail review at this time.

Klem is facing 23 criminal charges, including counts of attempted murder, robbery and forcible confinement.

At Klem's last court appearance, Superior Court Justice Robbie Gordon asked that the accused undergo a psychiatric assessment to determine whether he is a risk to the public.
