The boy's father, Amin Mohammed Kassim, was arrested in a Toronto apartment on Sunday night and charged with first-degree murder in the death of his estranged common-law wife, Muluka Hassan-Ali.
Another woman was with Kassim when he was arrested by emergency task force officers. But Det.-Sgt. Kathryn Martin said police do not expect to charge her.
Sammy was found in a different apartment, Martin said, and he was turned over to Children's Aid officials.

"There appears to be nothing wrong with him," she told reporters at a late-night news conference. "He's happy, and he's just going through a routine medical checkup."
Sammy was abducted in downtown Toronto early Saturday morning after his mother was shot several times in the head and killed.
Police found the body of Hassan-Ali, 23, in her apartment at 3:40 a.m. They issued an unusual 12-hour Amber Alert and appealed to Kassim to "do the right thing" and turn himself in.

The alert set into a motion a campaign to urge the public to be on the lookout for the 30-year-old man.
Police distributed his picture and that of Sammy. Electronic highway signs announced the missing child's name and description.
The alert produced a number of tips from the public, Martin said.
"It was tedious step by step police work, sourcing the information we got, chasing it down," she said. "This, in conjunction with the media and the assistance we got from the public, has ended in a very happy ending in terms of Sammy." Martin said Kassim will appear in court on Monday morning.
