A Manitoba man who claims he has been wrongfully convicted of murder has won a bail hearing for next month.

Kyle Wayne Unger has been serving a life sentence for the 1990 killing of teenager Brigitte Grenier. He was not in court Thursday when the hearing was set for Jan. 21.

Recent DNA tests suggest evidence used to convict the Manitoba man did not come from him.

Unger has filed an application under Section 696 of the Criminal Code, which allows the federal justice minister to intervene in cases where a miscarriage of justice may have taken place.

Federal Justice Minister Irwin Cotler must now decide whether to dismiss the application, refer the case to the Court of Appeal or order a new trial.
