A date has been set for the second trial of a Yorkton, Sask., man charged in the shooting death of his daughter's boyfriend.

Crown prosecutor Robin Ritter confirmed Thursday morning that Kim Walker will face the court on May 9.

The Saskatchewan Court of Appeal ordered the trial after overturning Walker's second-degree murder conviction in 2007.

In 2003, Walker was charged with murder after James Hayward, 24, was shot in his Yorkton home.

Walker believed the man had been supplying drugs to his daughter.

The original conviction was overturned after the Appeal Court learned a private meeting had been held between the judge and lawyers without Walker present.

The Criminal Code stipulates that an accused must be present during the entire trial.

A location for the new trial has not yet been determined.
