A Charlottetown man was found guilty Tuesday of sexually assaulting a resident of the Bedford MacDonald House homeless shelter while he was the manager there.
Everett Gallant entering court Dec. 5. (CBC)Provincial court Judge Nancy Orr called the testimony of Everett Gallant, 70, inconsistent and contradictory. Orr said Gallant took advantage of the victim who was homeless, helpless and penniless, and there is no way the victim could have consented under those circumstances.
Gallant had originally pleaded guilty to the charge, but during a sentencing hearing Gallant made references to the incident being consensual. At that time Provincial court Judge John Douglas found the testimony inconsistent with a guilty plea and threw the plea out.
During testimony earlier this month, the victim read from a journal he had kept during his stay there. He wrote he was upset by the sexual advances of someone old enough to be his grandfather. He also wrote he was worried he would get kicked out of the shelter if he objected.
Gallant will be sentenced Feb. 29, and will remain in jail until then.
