A Human Rights Commission panel made some mistakes in its awarding of lost wages to three workers forced to retire from the University of Prince Edward Island, says a P.E.I. Supreme Court judge.

Professors Tommy Nilsson and Richard Wills and staff member Yogi Fell successfully argued they should not have been forced to leave their jobs when they turned 65, but in a judicial review Justice Benjamin Taylor said he isn't sure they're eligible for all the lost wages awarded.

In September, a human rights panel ordered UPEI to pay the three employees a total of more than $335,000.

Taylor is asking the three-person panel to reconsider the amount, because the three didn't try hard enough to mitigate their losses by finding other work while waiting for a decision.

Only Nilsson actively tried to find a job, unsuccessfully making one application.

UPEI has argued the lost wages award should be reduced 50 per cent because of this lack of effort.
