University sued over forced retirement

Veterinarian Dr. Ian Moore is suing the University of Prince Edward Island in Charlottetown for $250,000, claiming he was not allowed to work there on the basis of his age.
In a statement of claim filed Dec. 22, Moore said he was denied a six-month leave of absence in October 2009 and was forced to retire in December of the same year.
Moore went to work for the Atlantic Veterinary College in 1996. He established the Ambulatory Equine Service for the college that year. He stayed on with the AVC for 13 years through a series of renewable contracts.
Moore applied for two positions at the AVC in 2010, but both were given to younger applicants.
He claims UPEI's conduct was related to his age. He's asking for 13 months pay, as well as punitive damages.
Moore refused to comment on the suit. No one with UPEI was available to respond.
The university has 20 days from the day the suit was filed to submit a defence.
Earlier this year UPEI lost a fight at the P.E.I. Human Rights Commission against faculty and staff who had been forced to retire.
