A $5 million lawsuit has been filed in P.E.I. Supreme Court against Lyndale Farms, near Montague.
The action was launched by Real Potatoes Limited of Cornwall, P.E.I., which researches and develops new varieties of potatoes. Real Potatoes alleges it has exclusive rights to commercialize a seed potato called Dakota Pearl.
Real Potatoes is claiming Lyndale Farms grew Dakota Pearl in 2008 and 2009 without its authorization.
Lyndale Farms has not yet filed a defence.
