A man arrested in Hamilton on accusations of aggravated sexual assault was returned to P.E.I. over the weekend to face the charges.

Darral James O'Regan, 56, was picked up Friday by two members of the RCMP's major crime unit. He is accused of having sex with two Islanders without disclosing that he had a serious medical condition.

RCMP said they began an investigation into the activities of O'Regan in June 2007 after receiving a complaint from a woman. They said they identified a second Islander who O'Regan had sex with during that time, also without disclosing his condition.

O'Regan was living on Prince Edward Island at the time. He since moved to Ontario. He was scheduled to appear in provincial court in Summerside at 9 a.m. Monday.

Police have not said what O'Regan's condition is, but a 1998 Supreme Court of Canada ruling confirmed that failing to disclose HIV-positive status to a sexual partner can be considered aggravated sexual assault even if the partner is not infected.
