The spa in Chelsea, Que., a municipality just outside Gatineau, is taking legal action against Quebec's Amerispa chain, which changed the name of a spa in nearby Cantley, Que., from "Baltique" to "Nordique."

Le Nordik claimed the new name is unfair and deceptive marketing.

"If you're hearing radio publicity, or even TV, and you're not looking you will definitely think that's it us," said Le Nordik account executive Marianne Trotier.

"We think they should use the name they used to have for their nordic spa."

Competitor argues their name is a common one

Amerispa said they should be allowed to call their nordic spa by what it is.

"We have 'spa nordik' everywhere in the province of Quebec so the way we use Spa Nordique is more than fair," said Amerispa spokesman Marc Gelinas, "But they have their opinion and I respect that."

Trotier said a lawsuit is the only way to ensure the name "nordic" is exclusive to the western Quebec spa.

Le Nordik is asking for exclusive use of the name "Nordik" and the right to claim damages in the lawsuit. The company is also building a new spa in Winnipeg, which is expected to open in the spring.
