The Whitehorse RCMP have been cleared of any wrongdoing in a case of a man who said he woke up in an RCMP cell naked and with a badly broken shoulder.

Wayne Hare filed an official complaint in January 2011 alleging police mistreated him. Hare also admitted he was so drunk that night that he has no memory of it.

The Lacombe Police Service in Alberta investigated the claims. Lacombe Police Sgt. Steve Murray interviewed all the officers, doctors and EMS staff on duty that night, as well as patrons at the Whitehorse bar where Hare had been drinking all day and right up to the closing time.

Murray said he also watched video from the cell block cameras during the time Hare was in custody.

“He remained fully clothed all of this is recorded he walked into a cell and repeatedly struck the cell door with his left arm,” said Murray.

Murray added that Hare was not mistreated while in custody.

“The audio video surveillance, the phone call logs, the radio logs which I examined in minute detail [show] that every member and staff of the RCMP in Whitehorse which Mr. Hare had dealings with on the night of January 15, 2011, treated him with respect, courtesy and dignity at all times.” said Murray.

Medical evidence showed Hare did have a broken shoulder, but that it had been broken several days before.

Murray’s report has been forwarded to Crown prosecutors who said there is no evidence to charge anyone in connection with Hare’s injuries.
