Police investigators from Lethbridge, Alta., have dismissed a complaint against Whitehorse RCMP, alleging the use of excessive force during an arrest.

Helen Hollywood, 57, laid the complaint following an incident in January.

Hollywood, who was part of the tent city occupation last summer outside the Yukon Government buildings, was living in a downtown apartment when police were called about an assault.

When they identified Hollywood as the suspect, she resisted arrest, and was forcibly handcuffed. Hollywood said police broke her arm in the struggle.

Two detectives with the Lethbridge Regional Police Service arrived in Whitehorse one week later to investigate.

After interviewing witnesses, Staff Sgt. Ian Sanderson said they found the force used by the police was reasonable.

"All conduct by the RCMP officer involved was justifiable, and there was no assault that occurred on the 57-year-old woman.”

Details of the probe were forwarded to the Public Prosecution Service of Canada for review, but criminal charges will not be laid.

Hollywood dismisses the police version of events and said she plans to fight the outstanding assault charges against her.

A two-day trial is scheduled for October.

Corrections and Clarifications

  • An earlier version of this story said the RCMP was charged with assault in the incident. The RCMP was never charged; instead, a complaint was lodged. (August 1, 2012, 3:16 PM MT)
