A judicial recount Tuesday confirmed that incumbent Ralph Wiseman is the mayor of Paradise, N.L.
It was the second recount of ballots from the Sept. 29 election that had initially declared Kurtis Coombs, 19, the community's new mayor by a three-vote margin.
Wiseman had requested the first recount.
Kurtis Coombs, 19, in Newfoundland and Labrador's provincial court Oct. 6. That recount resulted in a tie which, following provisions of the province's Municipal Affairs Act, was broken by drawing names from a container that held papers with both Coombs' and Wiseman's names written on them.
Wiseman was declared mayor when his name was drawn Oct. 1.
Coombs asked a judge to review that decision.
Last week, Newfoundland and Labrador provincial court Judge Robert Hyslop determined there should be a judicial recount.
On Tuesday, Judge David Orr confirmed the election had resulted in a tie of 1,821 votes, but he left it to town clerk and returning officer Joyce Moss to decide if another draw should be held. Moss decided the original Oct. 1 draw stands and Wiseman is the mayor of Paradise.
Coombs told CBC that he is not happy with the result, and he plans to challenge it further.
"The returning officer refused to draw another name," said Coombs. "The Municipal Affairs Act states very clearly that you go back to section 60 and draw again — which the returning officer is refusing to do."
Coombs says there should be another draw to decide who is the mayor of Paradise, and he promises that if he were to win another draw, he would hold another election to decide whom the residents of Paradise want as mayor.
