The Supreme Court of Canada dismissed a lawsuit over the 2004 wreck of the Ryan's Commander.
Joseph and David Ryan died at sea after their boat — the Ryan's Commander — capsized while returning from a fishing expedition.
Survivors of the two brothers filed a lawsuit in 2006 against Universal Marine Ltd., and Marine Services International Ltd. and its employee David Porter, alleging negligence in the design and construction of the fishing vessel.
On Friday, the Supreme Court ruled that the statutory bar within Workplace Health, Safety and Compensation Act did apply and the case was dismissed.
The widows of the Ryan brothers were already compensated under the act.
The Ryan's Commander was smashed against the shore at Spillar's Cove in September 2004.
