A man from the United States has been sentenced to 15 months in jail after pleading guilty to possession of child sexual abuse images and to smuggling the images into Canada at the St. Stephen border.

Shayne Clark, 31, of Philadelphia, was arrested at the crossing by members of the Canada Border Services Agency on Oct.13 when they searched his vehicle and found a laptop containing the images, RCMP Cpl. Chantal Farrah stated in a release.

Crown prosecutor Karen Lee Lamrock told the St. Stephen provincial courtroom that Canada's justice system uses five-categories to rate such images: 1) pictures of children posed nude, 2) sexual acts on themselves or with other children, 3) non-penetrative sex between children and adults, 4) penetrative sex between children and adults, and 5) bestiality.

All of the estimated 800 images and 384 videos found on Clark's computer involving human models fell into the first three categories, Lee Lamrock said.

Although there were some category four images of penetrative sex between children and adults, they were so-called anime files that are hand-drawn or computer generated, she said. These lifelike images are legal in the United States, but not in Canada, said Lee Lamrock.

None of the images involved bestiality, but some did involve violence, she said.

Clark, who was sentenced on Jan. 2, will have his name added to the National Sex Offender Registry for 10 years and was ordered to provide his DNA to the Offender DNA Data Bank, police said.

He is also prohibited from attending any public area where children under the age of 16 could be present, from having any contact with persons under the age of 16 unless under supervision, and from accessing the Internet.

Once released, Clark will be on probation for three years.

The maximum sentence for possession of child pornography is five years in prison. The minimum sentence was increased to six months from 45 days in August.
