A 19-year-old Moncton man has been sentenced to three years in prison for his role in a violent attack on a cab driver in November.

Kody Bryant MacPhail pleaded guilty to aggravated assault and robbery in December. A charge of attempted murder was dropped.

The victim of the assault, Wayne Horn, who was hospitalized for several days with serious injuries to his upper body, attended the sentencing in Moncton provincial court on Tuesday.

He told reporters he started driving his cab again last week, but the effects of the attack still linger.

“It can happen to me anytime," said Horn.

"I've dealt with the customers over the last 15 years, like, I'm 6'2", 260 pounds. That was my safety net. That was something that protected me from any incident in the cab. Who's going to mess with a big cab driver? So now that it happened it's like, where's my safety net?”

Judge Anne Dugas-Horsman sentenced MacPhail to three years for the aggravated assault, and opted for time-served for the robbery charge.

MacPhail had been in jail for 82 days, and turned 19 while incarcerated.

A 17-year-old Moncton man was sentenced earlier to 21 months in custody for his role in the same attack, which occurred on Nov. 23, about 12:30 a.m. in the parking lot of a gas station at 500 Hillsborough Rd.

A mini van from the White Cab company was dropping off two male fares, when the driver, Horn, was assaulted and robbed with a weapon. The suspects fled in the taxi, a gold coloured 2004 Chrysler Caravan.

The taxi was recovered in the Riverside-Albert area.

The attack on Horn has caused taxi companies to reconsider their safety policies.

Horn's van was equipped with a panic button at the time of the attack but he didn't get to it in time.
