The Winnipeg Police Service insists its officers were right to ticket a senior for allegedly talking on a cellphone while driving, despite a court decision that not enough evidence exists to proceed with the charge.

"The service, along with the two members, are extremely disappointed with the decision and feel that this matter should have proceeded to trial, giving the court an opportunity to determine the outcome," the police stated in a news release issued Friday.

Laszlo Piszker, 74, was given the $199.80 ticket in March, despite his claims he wasn't talking on a cellphone because he has never owned one in his life.

Winnipeg police disputed the couple's claims at the time. On Thursday, the couple learned the ticket was stayed.

Still, the police service is adamant its officers were just a few feet away from Piszker's vehicle when they saw him holding a cellphone to his ear.
