The daughter of a Winnipeg nursing home resident who died in 2010 is suing the facility in a case that provincial officials have called "physical abuse by neglect."

Lilian Peck, 93, was a resident of the Saul and Claribel Simkin Centre, a nursing home for Jewish seniors, when she died of an untreated bed wound in October 2010.

A Manitoba Health review last year described Peck's death as "physical abuse by neglect" and said nurses at the care home did not follow basic protocols.

Marsha Palansky, Peck's daughter, is now suing the Simkin Centre for damages totalling $70,000, plus funeral expenses of almost $7,900 as well as interest and costs.

In a statement of claim filed with the Manitoba Court of Queen's Bench last week, Palansky accuses the care home's staff of not properly caring for Peck.

Palansky says her mother had died of infection and sepsis to the groin area, according to the statement of claim.

The lawsuit names the company that owns the Simkin Centre, Sharon Home Inc., as well as seven nurses who worked there at the time of Peck's death. The allegations being made in the suit have not been proven in court.

When the Manitoba Health review became public, the Winnipeg Regional Health Authority said seven nurses at the facility had been disciplined, including one who no longer works there.

An external review of the home's operation was underway last fall, the WRHA said at the time.
