Lori Douglas is seeking to have the lawsuit against her thrown out. (CBC) A Manitoba judge and her lawyer husband, who are at the centre of a sex controversy, say the lawsuits against them should be dismissed.
Justice Lori Douglas has filed a statement of defence disputing allegations made by Alexander Chapman, a former client of her husband, Jack King.
In her statement, Douglas says the matters alleged by Chapman occurred more than six years ago and so the window of opportunity for a lawsuit has been closed under the Limitations of Actions Act.
She also claims the allegations in the statement of claim "fail to disclose a cause of action against her."
King made the same arguments in his statement of defence.
He further claims that Chapman signed a confidential settlement and release in 2003, agreeing to never bring legal action regarding the matter against King or his legal partners. As part of the settlement, King also paid Chapman $25,000.
Both King and Douglas have also filed notices of motion to dismiss the claims against them by Chapman. They are scheduled to present those motions to a judge on Wednesday in Winnipeg.
Sexually explicit photos
Douglas, King and the Winnipeg law firm of Thompson Dorfman Sweatman are being sued by Chapman for a combined total of $67 million.
Alex Chapman is suing a Winnipeg judge, her lawyer husband, and a law firm for a total of $67 million. (CBC) The lawsuits refer to incidents that occurred in 2003, when Douglas was still a lawyer and worked at the law firm with King.
She is now associate chief justice of the Court of Queen's Bench (family division).
Chapman first met King in 2002, when he retained the lawyer to handle his divorce.
Chapman claims King showed him sexually explicit photos of Douglas, naked in various forms of bondage, in chains, with sex toys and performing oral sex.
At some point in 2003, King also directed him to a porn website devoted to interracial sex, particularly between black men and white women.
Chapman, who is black, claims King tried to get him to have sex with Douglas.
Jack King accuses Alex Chapman of violating a 2003 confidential settlement and is suing on claims his privacy was breached. (CBC) When his divorce was concluded, Chapman filed a complaint to the managing partners at the law firm. Soon after receiving the complaint, King left the firm.
King's lawyer has said his client was suffering from depression at the time and was acting without Douglas's knowledge.
King has also filed his own lawsuit against Chapman, accusing him of violating the 2003 confidential settlement and claiming his privacy was breached.
Chapman, who didn't return the photos, has admitted to signing the agreement, but says he came forward this summer because he continues to feel victimized.
He is suing King for $10 million, Douglas for $7 million and the law firm for $50 million.
Douglas has temporarily stepped aside from her duties as a sitting judge but remains with the court in an administrative capacity.
She has declined to comment, saying it's a private matter.
