Winnipeg police confirmed Monday they are seeking an arrest warrant for an HIV/AIDS-positive man after two city women he allegedly had sex with tested positive for the virus.
Investigators were remaining tight-lipped about the case and not releasing the man's name.
Health officials haven't publicly commented on the case and haven't issued a public alert.
The man is from Sudan, and police believe he may now be living in Calgary, police sources said.
The two alleged victims are friends, and both say they were not told the man was HIV-positive, according to the same police sources.
Police could not say when they expect to execute the warrant nor what charges he could be facing.
Would be 2nd Manitoba case
It wouldn't be the first time in Manitoba that an HIV-positive man has been charged for failing to disclose his medical condition to sexual partners.
Clato Mabior, who is also from Sudan, is currently serving a 14-year sentence after being convicted in 2008 on six counts of aggravated sexual assault as well as invitation to sexual touching and sexual interference.
Mabior was found guilty of having unprotected sex with four females and protected sex with two others, including a 12-year-old.
Mabior's convictions hinged on his failure to disclose his illness to his sexual partners.
None of the women contracted HIV as a result of sexual contact with Mabior.
His convictions are currently under review by Manitoba's Court of Appeal.
Mabior argued before the court in February that his viral load was low at the time of the sexual contacts with the women and girls, and because of that, his convictions didn't meet the legal test of posing a significant risk of bodily harm to his victims.
The Crown contends he couldn't have possibly known what his viral load was at the time of the sexual activity.
If his convictions are upheld, Mabior faces immediate deportation at the conclusion of his sentence.
It is not known when the appeals court will rule on his case.
