John Schneeberger is appealing both his conviction and his sentence.
The Kipling doctor was convicted last year of drugging and sexually assaulting two female patients. He received a six year sentence.
Schneeberger tried to foil the police investigation into the assaults by inserting a thin tube of another man's blood into his arm. He then submitted that blood for DNA testing.
Schneeberger's lawyer says he will try to quash the warrants that allowed police to collect the DNA. He will also raise questions about the evidence that supported the charges of sexual assault.
The crown disagrees. It wants Schneeberger to serve even more time in prison.
