The Alberta Union of Provincial Employees is accusing the owners of the Hardisty Care Centre of illegally using a temporary foreign worker to do the work of striking employees.

The union which represents striking workers at the Edmonton seniors' facility filed a federal complaint against Park Place Seniors Living Inc. on Thursday.

Jim Petrie from AUPE says a replacement worker from India has admitted to strikers that he is on a one-year visa under the temporary foreign worker program.

"The complaint alleges that a temporary foreign worker is being used in contravention of the regulation that governs the program," Petrie said. "You're not allowed to use those individuals in a labour dispute."

Ian West, vice-president of operations for Park Place Seniors Living Inc, says his company does not engage in illegal activity.

Licensed practical nurses and nursing aides at the Hardisty Care Centre have been on strike since May 22 when they walked off the job in a dispute over wages.

The union claims the company pays workers 30 per cent less than what is called for in the Alberta Health Services collective agreement.

Park Place Seniors has been trying to reach a first contract with its employees since December 2011.
