A criminal investigation of two Edmonton police officers is likely after a judge found that a man was seriously assaulted during an arrest, say Edmonton police.

Provincial court Judge Donna Groves described the incident last year as an unwarranted, grave assault that can not be tolerated.

Edmonton police constables Nadine Comeau and Darin Goldenberg were on downtown patrol March 11, 2010 when they pulled over suspended driver Anthony Maskell.

In a written decision, Groves notes that Maskell was handcuffed and his head was smashed into his car.

His nose and several bones on the right side of his face were broken and he underwent surgery in hospital.

Groves convicted Maskell of driving while disqualified, but tossed out an impaired driving charge citing the beating he took.

The chief of police will be referring the case to the justice minister to decide if Alberta's Serious Incident Response Team should conduct the investigation.
