An older brother of the man killed during a police chase in Hinton, Alta., says his family just wants to get the body home to Saskatoon before getting caught up in whether the police chase was justified.

(Courtesy Jason Kerfoot)Brad Kerfoot, 30, was killed Nov. 19 on Highway 16 near Hinton, when a 21-year-old man driving a stolen van smashed into his truck while being chased by RCMP.

The chase is being investigated by the Alberta Serious Incident Response Team, but police said Tuesday the identity of the man driving the van has still not been determined.

"I just know they were chasing somebody and my brother was the innocent person," Jason Kerfoot told CBC News. "We're just worried on getting Brad home to Saskatoon and taking care of what needs taken care of right now."

Brad Kerfoot was living in Leduc, Alta., at the time of his death. His brother Jason lives in Calgary.

"I talked to him on Sunday [Nov. 15], doing some bets against the Edmonton Eskimos and the Calgary Stampeders," Jason Kerfoot said. "We always do a friendly beer bet."

"He was always very photogenic. If there was a camera, he was either taking the picture or wanted to be in the picture. So we definitely — we'll have some good shots of him to remember him."

Kerfoot is troubled that it wasn't the RCMP who notified his mother of Brad's death.

"They still haven't even contacted my mother, myself, my brother — anybody like that," Jason Kerfoot said.

"You would think in a tragic accident like this they would send somebody to the house instead of her getting a phone call from his girl friend in the middle of the night. Since the accident, they have never dropped by, called or anything, and I know my mom and even I are, like, it would have been a courtesy."
