Vancouver merchant Susan Heyes has lost her battle against the Canada Line transit-consortium.

In 2009, the B.C. Supreme Court awarded Heyes more than $600,000 because of lost business at her Cambie Street store during Canada Line construction.

Friday, the B.C. Court of Appeal overturned that award.

Heyes is outraged with the ruling.

"I am appalled that our legal system has failed to support the rights of citizens, and has attempted to provide legal justification for the excessive harm cause by this P3 project," Heyes said.

Heyes, who owns the maternity wear store Hazel and Co., sued three levels of government, two government agencies and the company building the line after she said she lost $900,000 and had to remortgage her home because construction of the Canada Line route stopped customers from visiting her shop.

She has since moved to a different location.

Translink said it is studying the ruling and will not have an immediate comment.
