Gerald Battersby, the 61-year-old man charged charged with the attempted murder of Yaletown bike shop owner Paul Dragan, did not appear in court Monday as scheduled, as he remains in hospital for treatment.

Battersby is facing six charges of attempted murder and several firearms charges, following a shooting outside a Starbucks in Yaletown earlier this month.

Police allege Battersby shot his former boss, bike shop owner Dragan, 52, then exchanged fire with police at the scene.

He then allegedly fled on a bike along the seawall to Science World, where he was arrested. During his arrest he was shot by police in his leg, arm and knee.

His previous court dates had to be rescheduled while he was recovering in hospital.

Battersby's family and another former boss told CBC News that he appeared to be having mental health problems prior to his arrest.

Dragan remains in hospital recovering. His family has not released details of his condition.
