THE 'FAINT HOPE' CLAUSE
(Section 745.6 of the Criminal Code)
WHAT
A chance for people convicted of murder or high treason to ask for parole after
15 years in prison.
Faint hope hearings are not a retrial or an
appeal of the original conviction. They focus on the convicted person's
character and rehabilitation.
HOW
Convince the chief
justice in the province where the conviction took place that a request
for early parole has a reasonable chance of success.
Have a
jury consider the application.
Apply to the National Parole
Board for release.
