Judge orders another recount in Vaughan election

A full recount in the Vaughan municipal election last November in which former mayor Michael Di Biase narrowly lost to Linda Jackson by 94 votes will take place, a judge has ruled.

The terms have not yet been ironed out, but lawyers representing the City of Vaughan and Di Biase will consult with Ontario Superior Court Justice Peter Howden about how to conduct the recount.

A computer recount of completed ballots was ordered by city council in late November after Di Biase disputed the results and found a four-ballot difference, widening the gap between the two rivals.

Wednesday's ruling marks only a partial victory for Di Biase, who had argued for a new election and claimed a number of "irregularities" caused votes to not be counted.

He claims problems with some electronic voting machines resulted in the rejection of 1,600 votes and some returning officers failed to follow proper procedures.

Di Biase also questioned the placement of several polling stations in a church, arguing it deterred some Orthodox Jewish voters.

The City of Vaughan had tried to quash the court challenge.
