Man gets conditional discharge in road-rage assault

A P.E.I. man was handed a conditional discharge for his part in a road-rage incident that sent another man to the hospital.

Todd Getson, 41, was found guilty in September of assault causing bodily harm.

In November 2008, Getson punched Allison McNally in the face after the two men clashed on a highway near Charlottetown.

McNally, an amputee who lost his arm in a farming accident, had been driving a vehicle on St. Peter's Road when a vehicle being driven by Getson's daughter pulled up behind him. Getson was a passenger in that car.

McNally said he pulled over to let them pass but the other car stopped behind him instead.

He testified he got out of his car, walked to the other vehicle and knocked on the driver's window before opening the door.

Getson said he heard his daughter scream and felt he had to protect her.

Provincial court Judge Nancy Orr said Getson was clearly provoked.

Getson has been ordered to pay $500 in damages and do community service work. He is also on 12-months probation.
