Tracyville man's child porn trial delayed again

There has been another delay in starting the trial of a Tracyville, N.B., man who is facing child porn charges.

Michael Gary Gilbert, 39, appeared Monday in Burton provincial court where he was supposed to select a method of trial.

Gilbert is facing 22 counts of sex-related charges, including making and possessing child pornography. He's also accused of sexual assault, sexual touching and sexual interference.

Gilbert has been in custody since the first charges were laid in January 2009.

He had been without a lawyer until last month, when he again failed to qualify for legal aid. The province stepped in and hired a lawyer to represent him.

However, Ron Morris, Gilbert's lawyer, said he needs more time to prepare, after Gilbert divulged further information to him on Monday.

Judge Patricia Cumming gave Gilbert a final adjournment until Nov. 16, when he will be expected to decide whether he wants to be tried by a jury or a judge alone.

Karen Lee Lamrock, the Crown prosecutor, said there are eight complainants, whose identities are protected under a court-ordered publication ban.
