The following terms and conditions govern fan voting and the determination of the bottom two competitors on the television series entitled Battle of the Blades ("Battle of the Blades" or the "Production"). These terms and conditions are subject to change at the sole discretion of CBC and Insight-Battle of the Blades 3 Ltd. ("Insight") (CBC and Insight shall be referred to collectively as "Producer").
"Battle of the Blades" phone and online voting is open to all persons located in Canada. Online voting via the Battle of the Blades Facebook Vote Application (“Battle App”) is available to Facebook account holders in Canada.
Voting via toll-free phone calls and/or the Battle App will be available at the following times:
Note: If attempting to vote outside of the Voting Periods your vote will be void.
In each Voting Period, online voting via the Facebook application is limited to one vote every minute per Facebook account. Votes via toll-free phone call are unlimited. The Producer reserves the right to change the limit on the number of votes that may be made from each originating phone number or Battle App installation, in the Producer's sole discretion.
2.1. Toll-free. To cast a vote using the toll-free phone numbers, simply dial the toll-free numbers displayed on screen at the end of each performance relating to your choice of competitor and as listed below:
Calls from payphones will be blocked, so use a standard landline or cell phone instead to vote.
If you are calling during a Voting Period you will hear a message prompting you to confirm your vote and you will hear a message thanking you for your vote once the vote has been accepted. Outside of a Voting Period, you will hear a busy signal or local carrier error message, and your call will not count as a vote.
Power dialing or block voting occurs when individuals unfairly influence the outcome of the voting system by generating significant blocks of votes using technical enhancements. Producer will have in place monitoring procedures designed to prevent this type of occurrence on "Battle of the Blades." If the Producer believes that power-dialing or block voting attempts were made, it reserves the right to remove these votes from the final tally.
2.2. Online voting. Votes for competitors can only be cast via the Battle App. To install the Battle App and cast votes for a competitor, you must have a valid Facebook account. A Facebook account is free and can be obtained if you are 13 years of age or older by following the “Sign Up” instructions found at www.facebook.com. If you already have a Facebook account, you can install the Battle App via www.cbc.ca/battle or via the official Battle of the Blades Facebook page located at http://www.facebook.com/battleoftheblades. Online votes are limited to one (1) vote per person every one (1) minute during the Voting Period.
For more information on how to vote using each voting method, please refer to the Vote FAQ.
3.1. Toll-free phone voting. Voting using the toll-free phone numbers is free from landline phones. If you are calling from a cell phone, airtime and applicable roaming charges will apply.
3.2. Online voting. Online voting is subject to standard access charges.
CBC, Insight and their respective parent, subsidiary and affiliated entities and persons (collectively, the "Administrators") are not responsible for and shall not be liable for difficulties, failures or malfunctions of phones (including wireless phones/handsets), phone lines or phone systems or other communications malfunctions; cellular equipment towers, phone systems or wireless services; interrupted or unavailable networks, applications or servers; miscommunications, failed computer hardware or software or other technical failures; garbled, lost, misrouted or scrambled transmissions; any error, omission, interruption, defect or delay in any transmission, communication or report; traffic congestion or for any technical or other problem which may cause the voting to be disrupted or corrupted.
If for any reason the voting is not capable of being executed as planned, or if there is an infection by computer virus, bugs, tampering, unauthorized intervention, fraud or technical or reporting failures, or if any other causes beyond the control of Administrators corrupt or affect the administration, security, fairness, integrity, or proper conduct of this voting, the Administrators reserve the right, in their sole discretion, to withdraw the transmission of any vote, but are in no way obligated to do so. Furthermore, the Administrators may, but are not obligated to, permanently disqualify any person they believe has intentionally violated these terms and conditions, and terminate or suspend voting at any point and declare the vote results based on the votes up to that point, if it appears that the voting process has been so distorted by hacking, failures, errors or other interference that the results would not reflect actual valid votes should the voting continue. In the event of technical or reporting difficulties with the online voting or phone voting, Administrators reserve the right to review the votes for accuracy and to take any appropriate action, including, without limitation, voiding the votes cast during the time period in which such technical or reporting difficulties occurred, but are in no way obligated to do so.
Administrators and their respective agents, officers, directors and employees assume no responsibility for any injury or damage to any person or to any other person's computer or other devices relating to or resulting from entering or downloading materials, applications or software in connection with this vote. Administrators are not responsible for telecommunications, network, electronic, technical or computer failures of any kind, for inaccurate transcription or reporting of voting information, errors in any promotional or marketing materials, for any human or electronic error, or for votes or reports that are stolen, misdirected, garbled, delayed by computer transmissions, lost, or late.
These voting terms and conditions are subject to change at any time at the sole discretion of the Producer. Notification regarding any such change will be posted at CBC.ca.
Caution: Any attempt by any person to deliberately damage any online service or website, tamper with the voting process, or otherwise undermine the legitimate operation of the voting is a violation of criminal and civil laws and should such an attempt be made, Administrators reserve the right to seek damages and/or other remedies from any such person to the fullest extent permitted by law.
