The Dukes are up, and it's going to be a barroom brawl.

In one corner, Duke University, in North Carolina. In the other, the son of "The Duke," legendary Western actor John Wayne. And, as might befit "The Duke," it's all over a bottle of whisky.

Ethan Wayne, son of "The Duke," has made a bourbon in his father's name. And Duke University, in North Carolina, says the whisky's name will "diminish, dilute and tarnish" its reputation -- and it plans to challenge the trademark.

So Mr. Wayne is taking Duke University to U.S. Federal Court to have a judge settle the issue.

"Seriously, look at our label. Tell me if you think there's any chance that the general public looking at that label and thinking its Duke University and not 'Duke' John Wayne," Ethan Wayne tells host Rick MacInnes-Rae.
